Terms of Service
This Terms of Service ("Agreement") governs the relationship between the Career Net Myanmar ("Agency"), Employers ("Clients"), and Employees ("Candidates") in connection with recruitment services, including a 6-month placement guarantee. By utilizing the services provided by the Agency, all parties agree to these terms and conditions.
1. Definitions
- Agency: The entity providing recruitment, screening, and placement services.
- Employer/Client: The company hiring Candidates referred by the Agency.
- Employee/Candidate: The individual recruited and placed with the Employer by the Agency.
2. Services Provided by the Agency
1. Recruitment and Placement
- The Agency will identify, screen, and refer qualified Candidates to meet the Client’s requirements.
- Assistance will be provided with the hiring process, including scheduling interviews and facilitating communication between the Client and Candidate.
2. 6-Month Placement Guarantee
- If a Candidate leaves the position or is terminated within six (6) months of the start date for reasons other than misconduct by the Client or changes to the agreed job role:
- The Agency will provide a replacement Candidate at no additional cost, or
- Refund a portion of the placement fee, as specified in the signed agreement between the Agency and Client.
3. Responsibilities of the Agency
1. For Employers
- Deliver pre-screened and qualified Candidates who meet the agreed-upon job specifications.
- Ensure the recruitment process adheres to legal and ethical standards.
- Provide timely replacements under the 6-month placement guarantee, if required.
2. For Employees
- Provide clear job descriptions, employment terms, and assistance in understanding contractual obligations.
- Support the Candidate with visa processing, onboarding, and other required formalities.
4. Responsibilities of Employers
1. Clearly define job roles, responsibilities, compensation, and other terms of employment.
2. Provide a safe, compliant, and supportive work environment in accordance with applicable labor laws.
3. Promptly notify the Agency of any issues with a Candidate’s performance or behavior.
4. Pay all service fees as agreed, including the placement fee, within the specified time frame.
5. Responsibilities of Employees
1. Provide truthful and accurate information about qualifications, experience, and employment eligibility.
2. Fulfill the duties outlined in the job description and employment contract.
3. Notify the Agency of any issues that may impact their employment status within the 6-month guarantee period.
6. Fees and Payments
1. Employer Fees
- A placement fee will be charged upon successful hiring of a Candidate.
- The exact amount and payment terms will be outlined in the signed agreement.
- Any additional costs (e.g., specific training, advertising, background checks) will be pre-approved by the Employer. - No additional fees will be charged for replacements under the 6-month guarantee.
2. Employee Fees
- The Agency will not charge employee for placement services unless legally permitted.
- A placement fee will be charged according to the service fee set by the government.
- The exact amount and payment terms will be outlined in the signed agreement.
- Employees may bear costs for optional training, certifications, or other services agreed upon in advance.
7. Placement Guarantee Terms
1. The guarantee covers instances where:
- The Candidate voluntarily resigns.
- The Candidate is terminated due to performance issues.
2. The guarantee does not apply if:
- The Employer changes the job role or terms of employment after hiring.
- The Candidate is terminated due to workplace misconduct or non-compliance with the agreed contract.
3. Replacements will be made within a reasonable time frame, depending on the availability of suitable Candidates.
8. Confidentiality
All parties agree to maintain the confidentiality of personal, professional, and proprietary information shared during the recruitment and placement process, except where disclosure is required by law.
9. Termination of Agreement
1. Employers or Employees may terminate their relationship with the Agency by providing written notice, subject to any agreed terms.
2. The Agency reserves the right to terminate services if:
- The Employer fails to fulfill payment obligations.
- The Employee provides false information or breaches their contractual obligations.
10. Dispute Resolution
Disputes arising from this Agreement will be resolved amicably through mediation facilitated by the Agency. If mediation fails, the dispute will be subject to legal proceedings under the governing laws specified in the signed agreement.
11. Liability
1. The Agency is not liable for:
- Misconduct or negligence by Employers or Employees.
- Any losses or damages resulting from unforeseen circumstances beyond the Agency’s control.
2. Employers and Employees are responsible for complying with legal and contractual obligations.
12. Governing Law
This Agreement is governed by the laws of the country where the Agency is registered, unless otherwise specified in the signed agreement.
Acknowledgment
By engaging in the services of the Agency, Employers and Employees agree to comply with these Terms of Service, including the conditions of the 6-month placement guarantee.
